Enforcement of Foreign Courts Decrees

Legalixa Turkish lawyers provide legal services in recognition of a foreign court decree. According to International Private and Procedural Law, enforcement of court decrees rendered by foreign courts in the course of civil lawsuits in Turkey which are final pursuant to the law of that foreign state shall be subject to the enforcement decision of the competent Turkish court. Thus we must file an enforcement lawsuit against the debtor in Turkey upon service of the original foreign court decree on parties (both the Plaintiff and the Defendant). Upon enforcement decision of Turkish competent court, we can commence execution proceedings before the competent enforcement office to collect the amount of debt.

The Courts of First Instance shall have jurisdiction over enforcement decisions. These decisions shall be requested from the court at the place of habitual residence of the person against whom enforcement is requested if he/she does have a domicile in Turkey, or from one of the courts in Istanbul, Ankara, or Izmir if he/she does not have a domicile or habitual residence in Turkey. Nevertheless, there is no unity in practice, because some civil courts of first instance reject the applications owing to lack of jurisdiction and send the file to the relevant commercial, intellectual property or labour courts.

Requirements for Recognition of a Foreign Judgment

The competent court in Turkey shall render enforcement subject to the following conditions:

  • The foreign judgement must be final under the laws of the foreign country & the Defendant must be properly and legally served with the original action in the foreign jurisdiction.
  • Existence of an agreement, on a reciprocal basis between the Republic of Turkey and the state where the court decision is given or a de facto practice or a provision of law enabling the authorization of the execution of final decisions given by a Turkish court in that state is required.
  • The judgment of the foreign country must have been given on matters not falling within the exclusive jurisdiction of the Turkish courts or, in condition of being contested by the defendant, the judgment must not have been given by a state court which has accepted himself competent even if there is not a real relation between the court and the subject or the parties of the lawsuit.
  • The foreign court decree shall not openly be contrary to public order. In other words, foreign judgments that violate Turkish public order cannot be recognized or enforced.
  • The person against whom enforcement is requested was not duly summoned pursuant to the laws of that foreign state or to the court that has given the judgment, or was not represented before that court, or the court decree was not pronounced in his/her absence or by a default judgment in a manner contrary to these laws, and the person has not objected to the exequatur based on the foregoing grounds before the Turkish court.

  • Who employ at least 50 employees and for whom a certificate of conformity is issued by the Ministry of Family, Labor and Social Services,
  • Who invest at least 500.000 US Dollars or its equivalent foreign currency or equivalent of Turkish Lira and make commitment to hold the amount of deposits for three years at banks operating in Turkey and for whom a certificate of conformity is issued by the Banking Regulation and Supervision Agency,
  • Who purchase public borrowing instruments at least 500.000 Us Dollars equivalent foreign currency or equivalent of Turkish Lira and make commitment to hold these instruments for three years for three years and for whom certificate of conformity is issued by the Ministry of Treasury and Finance,
  • Who purchase a real estate investment fund participation share or venture capital investment fund participation amount of at least 500.000 US Dollars or equivalent foreign currency or equivalent of Turkish Lira and make commitment to hold these participation shares for three years and for whom a certificate of conformity is issued by the Capital Market Board,

How to Get Divorced in Turkey Istanbul

How to Get Divorced in Turkey?

In Turkey, application for divorce is made to a family court with a petition. Mediation is not used in relation to divorces in Turkey. Under the Turkish Code of Civil Procedure, the court which has jurisdiction to deal with a divorce case is generally the court of the place where the parties are domiciled for the last six months. For these purposes, “domicile” means the place where they reside on a fixed and permanent basis.

When it comes to property disputes that arise out of a divorce case, different rules may apply. If the parties have, by the time of the property dispute, different domiciles (i.e. they’re permanently resident in areas covered by different courts), then the property dispute may be dealt with in the court where either of the parties is domiciled but, generally, the court that first took charge of the case will have priority and deal with the whole of the case.

The Process in Agreed Divorce

If the Parties are applying for a divorce on the “no fault” basis, and they’ve been married for at least one year, the process can be very quick. There will usually be a written agreement between the parties consenting to the divorce and setting out what should happen to the couple’s assets and their children.

The judge may accept the terms of this agreement and simply grant the divorce, or they may vary the terms of the agreements in so far as they relate to what should happen to the children: where they live, financial arrangements for them, etc. The judge may not vary the terms agreed about how the matrimonial property should be divided. An agreed divorce may be dealt with in as little as two weeks. Despite the fact that it is agreed, the Parties may appeal against the decision within 15 days.

The Process in Contested Divorce

Contested divorces are also dealt with by the courts in Turkey. The Court that has jurisdiction is determined by the rules set out above. During the course of the divorce hearing, the Court will decide whether the alleged grounds for the divorce exist and justify the divorce in legal terms and it will also decide what shall happen to the couple’s assets and children. The Court can also award the “innocent” party moral compensation for the behavior they have suffered or the stress they have been caused.

Real Estate Purchase by Companies

Trading companies are allowed to purchase real estate in Turkey within the limits of special statutes. The restrictions for foreign natural persons also apply to foreign trading companies. Associations, foundations, cooperatives and funds are not permitted to purchase real estate.

Military Areas

According to Turkish Law No. 2565, Article 9 (b) property which is located in a military area or a security zone may not be purchased by foreigners. The registry of deeds proves whether the real estate is located in such an area. This may cause significant delays because no registration in the cadastre may be done while the proving procedure is going on.
